Hypermark LLC ("Hypermark", "we", "us", "our") provides AI-assisted tools that help teams script, produce, and manage short-form video content (the "Services"). This privacy policy explains how we collect, use, disclose, and safeguard information when you visit our websites, use our applications, or communicate with us. By accessing the Services, you agree to the practices described here. If you disagree, please refrain from using the Services.
2. Information we collect
- Account & contact data: Name, email address, organization, role, profile photo, and authentication identifiers supplied when you create or manage an account.
- Billing & transactions: Payment tokens, billing contact details, tax identifiers, and order history processed via our payment processors. We do not store full card numbers.
- Usage & device data: Log files, browser type, operating system, IP address, cookies, pages viewed, referring URLs, feature usage, and timestamps captured to operate and secure the Services.
- User content: Prompts, uploads, scripts, media assets, images, logos, brand materials, and generated outputs that you add to projects. This content may contain personal data that you control. You are solely responsible for ensuring you have the legal right to upload and use all user content. See our terms of service for detailed intellectual property requirements.
- Support & communications: Messages, feedback, survey responses, and metadata from calls or meetings when you contact Hypermark for assistance.
We do not knowingly collect personal information from children under 13. If you believe a child has provided data to us, contact mike@hypermark.ai so we can delete it.
3. How we use information
- Authenticate users, deliver core product functionality, and personalize workspaces.
- Process payments, issue invoices, and manage subscriptions or usage credits.
- Operate, monitor, and improve the Services, including training guardrails that keep models reliable.
- Provide customer support, respond to inquiries, and share product updates or marketing (with opt-out).
- Detect, investigate, and prevent security incidents, fraud, or violations of our terms of service.
- Comply with legal obligations, enforce agreements, and protect Hypermark, our customers, and the public.
4. How we share information
- Service providers: Trusted vendors that host infrastructure, process payments, deliver communications, provide analytics, or help us support customers are granted access only as needed and under contractual obligations to safeguard data.
- Integration partners: When you connect Hypermark to third-party platforms (storage or AI model providers, for example), we share data as instructed by you to fulfill the integration.
- Legal & compliance: We may disclose information if required by law, court order, or to protect rights, property, or safety.
- Business transfers: If Hypermark undergoes a merger, acquisition, financing, or asset sale, we may transfer information as part of that transaction, subject to continued protections.
We do not sell personal information or share it with third parties for their direct marketing without consent.
5. Data retention
We retain personal data for as long as necessary to provide the Services, comply with legal obligations, resolve disputes, and enforce agreements. Project content remains available while your account is active and for a limited period afterward to facilitate restoration or export, unless you delete it sooner. We may retain aggregated or anonymized data for analytics.
6. Data security
Hypermark applies administrative, technical, and physical safeguards, including encryption in transit, access controls, monitoring, and regular testing, to protect information. No online service can guarantee absolute security, so please use strong passwords, enable multi-factor authentication when available, and contact us immediately if you suspect unauthorized activity.
7. User content & intellectual property
When you upload content to the Services, you represent and warrant that you have the legal right to do so. This section summarizes key points: please refer to our terms of service for complete details.
- Your responsibility: You are solely responsible for ensuring that all content you upload (including images, logos, brand assets, reference materials, and media) does not infringe any third-party copyrights, trademarks, rights of publicity, or other intellectual property rights.
- No IP screening: Hypermark does not screen, verify, or validate the intellectual property status of user content. We rely on your representations that you have proper rights to all materials you upload.
- Generated content: While you own the outputs generated from your legitimate user content, you remain responsible for ensuring that generated materials do not infringe third-party rights before using them commercially.
- Third-party claims: If we receive a valid complaint that your user content infringes third-party intellectual property rights, we may remove or disable access to such content. You agree to indemnify Hypermark for any claims arising from your user content.
- Rights clearance: If your content includes identifiable individuals, brand assets, licensed materials, or content created by others, ensure you have obtained all necessary permissions, licenses, and releases before uploading.
8. Your choices & rights
- Access, update, or delete account details from your workspace settings.
- Export or delete project assets using in-product controls or by contacting us.
- Opt out of marketing emails by following the unsubscribe instructions within those communications.
- Depending on your jurisdiction, you may request copies of your data, object to processing, or ask us to restrict use. Submit requests to mike@hypermark.ai.
We will respond to reasonable requests consistent with applicable privacy laws. We may need to verify your identity before fulfilling a request.
9. International data transfers
Hypermark operates from the United States and may process information in other countries where we or our providers have facilities. When we transfer personal data internationally, we rely on lawful transfer mechanisms and implement safeguards consistent with applicable law.
10. Changes to this policy
We may update this privacy policy periodically. The latest version will always be posted at this URL. If we make material changes, we will provide additional notice via email or in-app messaging when feasible. Continued use of the Services after an update becomes effective signifies acceptance of the revised policy.
